Yardkin is a garden app run by HiFive LLC d/b/a Yardkin, a Florida company ("we", "us"). By creating an account or using Yardkin, you agree to these terms. If you don't agree, please don't use it.
You must be at least 13 years old. If you're under 18, a parent or guardian should agree to these terms with you. You can't use Yardkin if the law where you live doesn't allow it.
Give us an email address you can receive mail at, keep your password to yourself, and tell us if you think someone else got into your account. You're responsible for what happens in your account, including in gardens you share with others.
Use the app for your own gardens. Don't break the law with it, upload anything that isn't yours to share, harass other members (including in the Market), try to get into other people's data, overload or probe the service, scrape it, or resell it. We may remove content or pause an account that breaks these rules.
Care schedules, watering estimates, plant facts, safety and toxicity notes, and everything the assistant says are general information, made by software and sometimes wrong. They are not professional horticultural, medical or veterinary advice. Check a product's label before applying it, and use your own judgment. If a person or pet may have eaten something harmful, call Poison Control at 1-800-222-1222 (in the US), your doctor or your vet right away, or emergency services.
Your gardens, notes and photos stay yours. You give us permission to store, copy, process and display them only as needed to run Yardkin for you and the people you choose to share with (for example to make thumbnails, send them to our AI provider when you ask for help, or show a public plant tag you print). This permission ends when you delete the content or your account, except for copies in backups that expire on their own.
Some plant information comes from others, with thanks: plant data from Wind River Greens under CC BY 4.0, taxonomy from the USDA NRCS PLANTS Database, and reference photos from Wikimedia Commons under each photo's own license, credited where it's shown.
Some features may cost money. When we offer a paid plan, its price, billing period, renewal, cancellation and refund terms will be shown before you pay, and those terms become part of these.
You can export your data and delete your account at any time in Settings. We may suspend or close an account that breaks these terms or puts the service or other people at risk, and we'll tell you when we reasonably can. We may also change or stop parts of the service; if we shut it down, we'll give you time to export your data.
Yardkin is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that it will be accurate, uninterrupted or error-free, or fit for a particular purpose. Plants die for many reasons; we can't promise a harvest.
To the extent the law allows, HiFive LLC d/b/a Yardkin isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost plants, crops, profits or data, arising from your use of Yardkin. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not all apply to you.
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts in Florida, unless the law where you live gives you the right to bring it there.
We may update these terms. When a change matters, we'll say so in the app or by email before it takes effect. Using the app after that means you accept the new terms.
